Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Rise application ("Rise" or the "App"), provided by EMBE LABS LLC ("EMBE LABS," "we," "us," or "our"). By downloading, installing, or using Rise, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use Rise. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf. By using Rise, you represent that you meet these requirements and that all information you provide is accurate and complete.

2. Account Registration

To access most features of Rise, you must create an account. You agree to:

• Provide accurate, current, and complete information when creating your account
• Maintain the security of your account credentials and not share your password with others
• Notify us immediately at team@embelabs.xyz if you become aware of any unauthorized access to your account
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period, with notice where reasonably practicable.

3. Subscriptions and Payments

3.1 Paid Features, Trials, and Promotional Access

Rise may offer paid subscription plans, free trials, promotional access, or limited free features. The features, pricing, and availability of each plan are described within the App and may change over time.

3.2 Billing

All subscriptions are purchased and managed through Apple's In-App Purchase system. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Subscription terms, renewal details, and pricing will be shown before purchase in the App Store purchase flow.

3.3 Free Trials

If we offer a free trial, it begins when you start the trial and converts to a paid subscription at the end of the trial period unless you cancel before the trial ends. You will be charged the applicable subscription price at the time of conversion.

3.4 Managing and Cancelling Subscriptions

You may manage or cancel your subscription at any time through your Apple ID account settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period. Refund requests for purchases made through Apple are handled by Apple, not EMBE LABS, except where required by applicable law.

3.5 Price Changes

We may change subscription prices at any time. We will provide reasonable advance notice of price changes through in-App notification or email. Your continued subscription after a price change takes effect constitutes acceptance of the new price.

4. Permitted Use

Rise is a personal Bible study, prayer, sermon note-taking, and devotional tool. Subject to your compliance with these Terms, EMBE LABS grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Rise on Apple-branded products that you own or control, and as otherwise permitted by the Apple Media Services Terms and Conditions, solely for your personal, non-commercial use.

You may use Rise to:

• Engage in AI-assisted Bible study, prayer, and faith-related conversations
• Record, transcribe, and review sermons for personal use
• Create and store Bible notes, highlights, and reflections
• Access devotional content and worship features within the App

5. Prohibited Conduct

You may not use Rise to:

• Violate any applicable law or regulation
• Submit content that is abusive, harassing, threatening, defamatory, obscene, or otherwise objectionable
• Attempt to gain unauthorized access to any part of the App, our servers, or any systems connected to the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Scrape, crawl, or extract data from the App by automated means
• Use the App in any way that could damage, disable, overburden, or impair our infrastructure
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Use the App for any commercial purpose, including reselling access to Rise features
• Circumvent any access controls, subscription enforcement, or technical protection measures in the App
• Use the App in any manner that violates Apple's App Store terms and guidelines
• Generate, request, or distribute content that promotes self-harm, violence, exploitation, abuse, illegal activity, or evasion of safety systems
• Attempt to manipulate, bypass, or disable AI safety systems, moderation, rate limits, subscription limits, or usage controls
• Use automated scripts, bots, or high-volume prompts to abuse or degrade the App or its underlying AI services

6. User Content

6.1 Your Content

You retain ownership of all notes, recordings, messages, and other content you create within Rise ("User Content"). By providing User Content to the App, you grant EMBE LABS a limited, worldwide, royalty-free license to host, store, reproduce, process, analyze, transmit, and otherwise use your User Content solely to operate, provide, maintain, personalize, and improve Rise for you.

6.2 AI-Generated Content

Rise uses artificial intelligence to generate Bible study responses, devotional content, and other outputs ("AI Content"). AI Content is provided for personal spiritual exploration and study. You understand and agree that:

• AI Content is not theological counsel or pastoral advice. Rise is not a substitute for a licensed pastor, minister, spiritual director, or mental health professional.
• AI Content may be inaccurate. While we strive for biblical accuracy, AI systems can make mistakes. Always verify important theological claims against Scripture and trusted sources.
• AI Content is not a crisis resource. If you are experiencing a medical or mental health emergency, thoughts of self-harm, thoughts of harming others, abuse, or immediate danger, call emergency services or a crisis hotline immediately. Rise is not designed to detect, prevent, or respond to emergencies.
• AI Content may not reflect any particular church, denomination, or religious authority. AI Content may vary across users and sessions and does not represent the views of EMBE LABS, any pastor, church, denomination, or religious authority.
• You are responsible for how you interpret and apply AI Content in your life.

6.3 Content Standards

You agree not to submit User Content that infringes any third-party intellectual property rights, violates any law, or contains viruses, malware, or other harmful code. We reserve the right to remove User Content that violates these Terms without prior notice.

7. Sermon Recordings

The sermon recording and transcription feature is provided for your personal spiritual growth and note-taking. By using this feature, you represent and warrant that:

• You have obtained any necessary permission from the relevant church, pastor, or speaker before recording, if required
• You will use sermon recordings only for personal, non-commercial purposes
• You will not use recordings to infringe the intellectual property rights of the speaker or church

Recording laws vary by jurisdiction, venue, church policy, and circumstances. You are solely responsible for determining whether recording is permitted before using this feature. EMBE LABS is not responsible for any copyright or other legal issues arising from your use of the recording feature.

8. Intellectual Property

8.1 Our Intellectual Property

Rise and all its content, features, design, software, branding, trademarks, and technology — excluding User Content — are the exclusive property of EMBE LABS LLC or our licensors. Nothing in these Terms grants you any right to use our trademarks, trade names, or branding without our prior written consent.

8.2 Scripture and Third-Party Content

Biblical text displayed in the App may be sourced from Bible translations that are themselves subject to copyright. Translations are used in accordance with applicable licenses. Some Bible translations may be subject to usage limits, attribution requirements, or separate license terms. Rise does not claim ownership of any Scripture text.

8.3 Feedback

If you provide us with suggestions, feedback, or ideas about Rise, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation or attribution to you.

9. Privacy

Your use of Rise is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Rise, you agree to the collection and use of your information as described in the Privacy Policy.

10. Third-Party Services

Rise integrates with third-party services to provide its features, including OpenAI's API, speech-to-text providers, cloud infrastructure providers, analytics, crash reporting, authentication, and Apple services. Your use of these features involves the transmission of data to those third parties as described in our Privacy Policy. Third-party services are governed by their own terms of service and privacy policies. EMBE LABS is not responsible for the practices or content of third-party services.

The App may also integrate with or link to third-party platforms such as Apple Music (for worship features). Your use of such platforms is governed by their own terms.

11. Apple-Specific Terms

Rise is distributed through the Apple App Store. You acknowledge and agree that:

• These Terms are between you and EMBE LABS, not Apple. Apple is not a party to these Terms and has no obligation to provide support for the App.
• Apple has no warranty obligations with respect to Rise. Any claims arising from the App — including product liability claims, consumer protection claims, intellectual property infringement claims, and claims under third-party agreements — are the sole responsibility of EMBE LABS.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
• Your use of Rise must comply with the Apple App Store Terms of Service.
• EMBE LABS, not Apple, is responsible for addressing any claims you or any third party have relating to the App or your possession and/or use of the App.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• RISE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE.
• WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED CONTENT WITHIN THE APP. AI CONTENT DOES NOT CONSTITUTE THEOLOGICAL, PASTORAL, LEGAL, MEDICAL, OR PROFESSIONAL ADVICE OF ANY KIND.
• RISE IS A BIBLE STUDY AND DEVOTIONAL TOOL. IT IS NOT A SUBSTITUTE FOR PARTICIPATION IN A LOCAL CHURCH COMMUNITY, PASTORAL CARE, LICENSED COUNSELING, OR PROFESSIONAL MENTAL HEALTH SERVICES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMBE LABS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE RISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF RISE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100 USD IF YOU HAVE NOT MADE ANY PAYMENTS TO US.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless EMBE LABS LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your User Content; (c) your use of Rise in violation of applicable law; or (d) your infringement of any third-party rights.

15. Termination

We may suspend or terminate your access to Rise at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or if required to do so by law. You may terminate your account at any time by deleting your account within the App settings or contacting us at team@embelabs.xyz.

Upon termination: your license to use Rise ends immediately; we will handle your data as described in the Privacy Policy; provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will survive.

16. Dispute Resolution

16.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at team@embelabs.xyz and give us 30 days to attempt to resolve the issue informally.

16.2 Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Georgia for any disputes not subject to arbitration.

16.3 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT AGAINST EMBE LABS LLC.

17. Changes to These Terms

We may update these Terms at any time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you via in-App notification or email. Your continued use of Rise after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using Rise.

18. Miscellaneous

• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and EMBE LABS with respect to Rise and supersede all prior agreements.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
• Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
• No third-party beneficiaries: Except as expressly stated in Section 11 (Apple), these Terms do not create any third-party beneficiary rights.
